Sen. Roger Marshall aids migrant suffering from heat exhaustion during dramatic border trip

Sen. Roger Marshall, R-Kansas, gave assistance to a migrant suffering from heat exhaustion on a recent dramatic trip to the southern border -- an incident that he said was a window into the "unsustainable humanitarian crisis" at the U.S.-Mexico border.

Marshall, a physician, was on a trip to the border in Texas, along with sheriffs from Kansas and was riding along with Border Patrol agents in an area between where smugglers drop off illegal migrants, and where they are picked up by others. It’s a hazardous area with treacherous conditions for migrants who have often traveled thousands of miles.

"This is rough wilderness,," Marshall told Fox News Digital in an interview, noting the risks of rattlesnakes, the Texas brush and the heat. "It’s hot already down there."

Agents spotted a human smuggler pull up to an area, bring four or five people into the car -- as well as one in the trunk. Agents gave chase until the car pulled over and the inhabitants fled.

Agents caught many of those fleeing, including one woman who Marshall said was showing severe symptoms of heat exhaustion that had the potential to turn deadly. It was then that he stepped into action.

"The one young lady was obviously having heat exhaustion, and maybe she was bordering on heat stroke so when they brought her I was able to look at her, and …her respiration was really fast, her pulse was 140, she hadn’t drunk water in two days, her knee was hurting, her hand was cut up from the barbed wire fence, and I really think she’d have probably died in, I don’t know, an hour or two."

Video issued by Marshall’s office shows the M.D. giving her water, examining her wounds, and helping to carry her to a cooler area and calm her breathing.

"We got her cooled down, got water to her, just basic first aid, so that's what you’re seeing me attend to her health needs," he said.

While heat exhaustion is not uncommon at the border, the risk of that developing into heatstroke is significant.

"I don't get intimidated by situations and when they brought her back over the fence and I saw her breathing as she was I knew she was in distress, the agent yelled for help, and she was semi-conscious, fading in and out. That’s heat exhaustion going into heatstroke, and once heat stroke starts, it's almost irreversible," he said.

Despite him stepping up to help, he emphasized that it's the Border Patrol agents, who do this work and tackle these conditions every day, who are the heroes of the story.

"Those poor officers are expected to be nurses, social workers, psychologists and at the same time have to keep themselves safe and keep America safe," he said. "I was able to do my little part, but they're the true heroes, not me."

Marshall said that the incident showed the "unsustainable humanitarian crisis" at the border that affects not only Americans but the migrants themselves, who have often traveled hundreds of miles on foot and can be exploited by trans-criminal organizations.

"So by the time they show up they have dysentery, they're dehydrated, they have wounds, infections, many of them have been sexually abused, all the things you can imagine, and then many people are dying on the way from the heatstroke, from dehydration and then more dying as they drown coming across the river," he said.

He put the blame squarely on the policies of President Biden and said the agents had told him that what they need is to get back to the policies of the Trump era, including finishing construction of the border wall.

Three migrants trying to illegally enter US have to be rescued after getting stuck atop Trump border wall

Three immigrants attempting to illegally enter the U.S had to be rescued by California firefighters when they got stuck atop the southern border wall that former President Trump built.

Members of the San Diego Fire-Rescue Department responded to a call for assistance from U.S. Customs and Border Protection after three men scaled the 30-foot steel barrier in Tijuana and found they had no way to get back down the other side into the United States.

The three males were summarily taken into custody by Border Patrol agents.

NBC 7 in San Diego reported calls for rescue assistance have increased, owing largely to misleading advice from drug smugglers.

“It’s a very common rescue that we have down here in [Otay Mesa],” Cal Fire San Diego County Capt. Brett Bruno told the outlet. “They can get up in between the fences but they can’t get down on this side without causing significant injury.”

At least 375 migrants have been treated for serious injuries caused by falls from the border wall between 2019 and 2021 in San Diego County, the Daily Mail reported. Conversely, only 67 people were injured in accidents between 2016 and 2019.

A study conducted in April by UC San Diego Health blamed the increase in injuries and deaths on Trump’s executive order of January 2017, which increased the height of the wall to 30 feet across some 4oo-plus miles of the barrier. Prior to that order, some portions of the border wall were as low as six feet.

The study cited 16 fatalities since 2019 where previously there were zero deaths.

“The height increase of the border wall along the San Ysidro and El Centro sectors was touted as making the barrier ‘unclimbable’ but that has not stopped people from attempting to do with consequential results,” wrote Dr. Amy Liepert, the UC San Diego Health medical director of acute care surgery.

“Additional capacity and associated costs were not accounted for in the federally appropriated funds to reinforce and heighten the border barrier system,” Liepert continued. “Hospital costs for border wall-injured immigrants at UC San Diego Health alone are estimated to be approximately $13 million between 2019 and 2021.”

“This is a local public health crisis that has worsened trauma center bed capacity, resulting in staff shortages and has taxed our extremely dedicated health care professionals,” wrote Dr. Jay Doucet, the division chief of trauma and surgical critical care at UC San Diego Health. “It is also a humanitarian crisis in which people are being severely injured or dying at the border, and because this is happening it is impacting available access to trauma care for San Diegans as well.”

U.S. Customs and Border Protection says drug traffickers continually misrepresent the dangers of trying to scale the border wall to those seeking to enter the U.S. illegally.

Joe Biden’s Border Mess is Killing Americans

Joe Biden’s border mess has created myriad crises for the American people, none of which are worse than the fentanyl epidemic that is destroying so many of our fellow citizens.

Data released earlier this month found that 2021 was the deadliest year on record for drug overdoses, with more than 107,000 Americans dying of an overdose that year. The main driver of these tragic numbers is fentanyl, a drug that mostly flows through the southern border at the behest of drug cartels and kingpins. Of the 107,000 deaths from overdoses, over 70,000 involved fentanyl.

"These past three years we have seen an increase of contamination of other illicit drugs with fentanyl, be it cocaine, be methamphetamine, and more recently, illicit prescription drugs,” Dr. Nora Volkow, director of the National Institute on Drug Abuse said.

Most of these deaths could be better described as poisonings rather than drug overdoses. Many who die of fentanyl overdoses die because they are doing other drugs that happen to be laced with fentanyl. The tiny amount of fentanyl dosage required to kill someone is what makes this drug so dangerous and so lethal.

There are many reasons for America’s decades-long opioid crisis, including recent COVID-19 restrictions that forced many Americans into isolation. However, the main reason for the crisis is our abandoned border, through which most fentanyl flows. Bad actors in China and Mexico are now working together to move fentanyl into the U.S., with Chinese manufacturers and Mexican drug cartels having formed a closer relationship in recent years.

During Biden’s first year in office, Border Patrol reported a staggering 1,066 percent increase in the amount of fentanyl seized at the southern border. The agency seized 588 pounds of fentanyl in 2021, which would be enough to kill the entire U.S. population multiple times over, and that’s just the amount that was unable to escape detection.

One can only imagine the total amount of fentanyl that has come through our border undetected. The Drug Enforcement Agency (DEA) has imagined this, and issued a warning last month about a looming nationwide spike in fentanyl overdoses, saying that the drug is killing Americans at an “unprecedented rate.”

”Drug traffickers are driving addiction, and increasing their profits, by mixing fentanyl with other illicit drugs,” DEA Administrator Anne Milgram said. “Tragically, many overdose victims have no idea they are ingesting deadly fentanyl, until it’s too late."

The vast majority of drug overdoses occur among young and middle-aged Americans. Between 2010 and 2016, opioid-related deaths accounted for the loss of over half a million years of life in just the state of Ohio, according to a study from the Journal of Addiction Medicine. Now, we have the DEA telling the American people to expect those numbers to skyrocket. The scourge of fentanyl and other drugs coming from Mexico requires a whole-of-government effort to secure our border. Tragically, the Biden administration continues to take the opposite course.

Despite an injunction that is temporarily halting their efforts, the White House is determined to end the use of Title 42 to expel migrants at the border to prevent the further introduction of COVID-19 into the country, which will cause even more mass chaos at our border. Some estimates have found that as many as 18,000 illegal aliens will begin crossing the southern border every single day once the Title 42 order is lifted, meaning that Americans can anticipate as many as 500,000 illegal alien border crossings every month. This will force agents off the line in order to help manage and process migrants, which will create more openings for cartels to smuggle humans and drugs into the U.S.

Our immigration system is about to be completely overwhelmed, and drug cartels will be prepared to ruthlessly exploit that reality, which will exacerbate the opioid crisis, and lead to further death and despair.

Joe Biden’s border mismanagement is getting Americans killed, and younger and more economically vulnerable Americans are paying the heaviest price. If Biden gets serious about securing the border, he can end this carnage. Tragically, it appears he will continue to act as the fentanyl traffickers’ de facto partner at the border.

UK immigration SURGE: Visas now staggering 145% HIGHER than 2021 as Tories turn on Patel

More than 1.6 million visas and permits were granted by the Government in the year ending March 2022, the Home Office has said. The figure marks a 145 percent increase on the previous 12 months to March 2021, according to the latest available immigration statistics, published on Thursday. However, the total is around half the number that was granted in the year ending March 2020, the period leading up to the COVID-19 pandemic.

Of the visas granted in the latest 12 months, 38 percent were to visit, 29 percent for study, 17 percent for work, three percent for family reasons, and 13 percent for other reasons, the Home Office said.

The new figures also show that the Government has granted less than half of the applications by people wanting to come to the UK from Ukraine amid Russia’s invasion.

Some 60,482 applications were received across both Ukraine visa schemes but only 27,979 have been granted.

The rate of total UK asylum applications granted has hit 75 percent – its highest in over 30 years (the rate was 82 percent in 1990).

According to the Home Office, this huge uptick in the acceptance of asylum seekers has been influenced by Brexit.

It explained: “The rise in grant rate is in part because of the low number of refusals (including third country refusals, which have been affected by the UK leaving the EU), although the overall grant rate can vary for a number of reasons.”

The total number of asylum applications – 55,146 – in the year ending March 2022 was also the highest since 2003.

The figure is 56 percent more than in the year ending March 2020 and higher than at the peak of the European Migration crisis of 2015.

Ahead of the release of the Home Office data, a string of Tory MPs hit out at Priti Patel over the “drastic increase” in net immigration.

Referring to the new statistics before they were published, the group warned the Home Secretary that the rise “undeniably undermines” the Government’s Brexit promises.

Often vilified by liberals, Border Patrol agents rushed into Texas school to neutralize shooter

Border Patrol agents, often vilified by progressive members of the Democratic Party, were among the first to arrive on the scene of the mass shooting at an elementary school in Texas on Tuesday. One Border Patrol agent is reported to have "shot and killed" the 18-year-old gunman.

The active shooter incident has, thus far, left at least 19 children and two adults dead.

Marsha Espinosa, a spokesperson for the Department of Homeland Security, tweeted: "U.S. Border Patrol Agents responded to a law enforcement request for assistance [for] an active shooter situation inside Robb Elementary School in Uvalde. Upon entering the building, Agents & other law enforcement officers faced gun fire from the subject, who was barricaded inside."

The agents placed "themselves between the shooter and children on the scene to draw the shooter's attention away from potential victims and save lives," she continued. "At least one Border Patrol Agent was wounded by the shooter during the exchange of gunfire. On-and-off duty Border Patrol Agents arrived on the scene to assist with transferring students safely to their families and providing medical support."

About 80 border agents responded to the mass shooting at the elementary school in the city of Uvalde, close to the U.S.-Mexico border.

Harris has abandoned ‘border czar’ role — will anyone remedy Biden’s disaster?

Vice President Kamala Harris is supposedly the White House point on the border surge, but the issue has vanished from her schedule, the Los Angeles Times reports; she hasn’t hosted an immigration event in nine months.

This, though April saw a record 234,088 migrants apprehended at the southern border. Team Biden released 110,000 of those migrants into the interior, and you can add the many thousands who never got caught to that total.

And “root causes” Harris has stopped pretending to do anything about it, after a few Central American photo-ops and blank “do not come” appeals. (Her press secretary lamely insists she’s still on it.)

Despite the issue being at the top of the list of crises facing the country, it’s obvious no one in the White House wants to touch the growing disaster.

After all, the real Biden approach here is “let ’em in,” and who wants accountability for the inevitable results?

Abbott celebrates continuation of Title 42 at border, but says long-term solutions are needed

Gov. Greg Abbott again slammed the Biden administration over its handling of immigration policy and enforcement on Monday during a visit to Eagle Pass, in which officials briefed the governor on state-run border security operations.

Abbott’s trip coincided with what would have been the expiration of Title 42, a pandemic-era policy adopted under Trump that allows for the rapid expulsion of migrants at the U.S. border, but a federal judge blocked the Biden administration from ending the program days earlier.

Abbott cautiously celebrated the judge’s ruling in remarks to press, but stressed the need for more long-term solutions to address the surge of migrants border officials are facing.

“One thing that we know for a fact, and that is there are maybe as many as 100,000 migrants who are across the border waiting to cross into the state of Texas,” Abbott said. “And we as a state, we being the local communities that are represented here in this room today, they're all dealing with the enormous challenge of having a tidal wave of people come into their communities.”

Originally implemented during the Trump administration as a health policy, Title 42 allows border authorities to turn away migrants at the border, including those seeking asylum, in order to limit the spread of COVID-19.

Despite its origins as a health policy under the authority of the Centers for Disease Control and Prevention, Title 42 has become the center of a fierce debate over immigration policy.

More:Texas sues Biden administration over plans to end Trump-era Title 42 immigration policy

Republican-led states, including Texas, sued to stop Title 42 from ending on May 23rd as scheduled, arguing that state and federal authorities are not prepared to handle the massive influx of migrants anticipated upon the policy’s expiration.

Recent numbers released by the federal government showed that in April authorities came across more than 230,000 migrants attempting to enter the U.S. without authorization, with more than half of those encounters happening in Texas.

Abbott has made border security one of his top priorities and has heavily campaigned on it, touting his initiative to address the issue, known as Operation Lone Star.

Abbott launched Operation Lone Star in March 2021, deploying thousands of Texas National Guard troops and Texas Department of Public Safety troopers to the border in order to tackle a sharp increase in illegal immigration, and drug and human trafficking.

However the operation has since faced significant criticism after reports emerged that troops were experiencing delays in pay, insufficient equipment, plummeting morale, and a streak of suicides among service members deployed as part of the program.

Texas sues Biden administration over new border policies
Earlier Monday, state Attorney General Ken Paxton announced that he had filed a second lawsuit in hopes of blocking the Biden administration from changing the way asylum requests are handled at the border with Mexico.

The new procedure, set to take effect May 31, is intended to reduce yearslong immigration backlogs by allowing asylum officers to rule on immigrant requests for permission to legally enter the United States to escape persecution, or fear of future danger, in their home countries.

The goal, federal officials said, is to make the decision within months to grant asylum to those who deserve it or promptly remove those who do not, but Paxton argued that the new policy would encourage illegal immigration by making it easier for people to enter the country under false pretenses.

The new rule also violates federal law, which requires asylum decisions to be made by immigration judges, not asylum officers, Paxton said.

"The Biden administration has made it clear that they do not want to abide by the Constitution or the rules and regulations set by Congress, especially regarding the Texas border," he said in a statement. "This entire rule is just a way for this administration to accomplish their real goal: a mass influx of illegal aliens into the United States."

Monday's lawsuit joiins a similar challenge Paxton filed last month in Amarillo federal court, putting the matter before U.S. District Judge Matthew Kacsmaryk, who was nominated by former President Donald Trump.

Federal judge blocks Biden from ending Title 42

Against his will, President Joe Biden got a small reprieve from his self-inflicted border crisis by U.S. District Judge Robert Summerhays when he issued a temporary injunction on Friday, May 20 against Biden’s order to end Title 42, which was supposed to happen Monday, May 23.

To the consternation of not a few of his fellow Democrats, Biden’s administration issued the order to end the CDC’s public health order meant to protect Americans from infectious diseases and viruses such as COVID-19 by allowing CBP to immediately expel illegal border-crossers back to Mexico or country of origin in early April.

Upon issuing the order, more than 20 states including Arizona and Texas which share a border with Mexico filed a lawsuit challenging President Biden’s authority to end Title 42 at this time. Judge Summerhays considered the lawsuit on its merits and determined irreparable harm could be done to the states and issued his injunction.

But now that President Biden has been given a reprieve from his ill-conceived order, will he do right by the American public and capitalize on this ruling by making a course correction on his failed border security policies? Or, will he exercise his executive powers to defy the judiciary, a co-equal branch of government?

If history is a guide and as we rely upon the following evidence, we must conclude the answer is the latter.

First, President Trump applied Title 42 to all countries uniformly. Under his leadership nearly 98 percent of all illegal border-crossers were expelled upon apprehension, which was one of the reasons he was able to keep criminal cartels in check and illegal border crossings to relatively low levels.

But under President Biden, the percentage of Title 42 expulsions dwindled month over month until last month in April he expelled less than 50 percent of those who crossed the border illegally. While President Trump applied Title 42 to all countries, President Biden has given carve-outs to nearly all countries except for a few like Mexico, Guatemala, Honduras, and El Salvador.

Second, President Trump ended the catch-and-release program which got rid of the magnet that draws so many people to our borders and allows the cartels to generate billions of dollars in profit. In other words, Trump stopped rewarding people for violating our laws by releasing them into the U.S. and instead delivered a consequence for all who crossed our borders illegally. But upon taking office, President Biden immediately reversed President Trump’s policies and brought back catch-and-release on a scale never before seen. In fact, last month, President Biden released more than 110,000 illegal border-crossers into the U.S. while only expelling approximately 95,000.

Because the Biden administration is actually encouraging people to cross our borders illegally by rewarding them with a free pass into the U.S., is there any wonder why illegal immigration has exploded?

The judge’s decision on Title 42 gives admin more ‘time’ to get a handle on the border: Susan PageVideo
Third, the explosion in illegal immigration is forcing the Border Patrol to assign more agents to administrative duties instead of to enforcement duties. And so, cartels are exploiting deficiencies in the Border Patrol’s operations and the number of got-aways has not only hit record highs but has passed the point of being extremely dangerous to the American public. More than 750,000 illegal border-crossers have been able to evade apprehension after being detected. This number shatters all previous records.

Fourth, historically at this time of the year, the Border Patrol apprehends approximately 1,400 illegal border-crossers per day. But due to President Biden’s policies, including his selective enforcement of Title 42, the number of daily arrests currently stands at more than 7,000. These sheer numbers have caused the destabilization of the southwest border, granting control of large portions to criminal cartels.

While all of this is bad, it can change immediately. And Judge Summerhays gave President Biden the political coverage he needs to make a course correction.

Under the guise of the rule of law, President Biden can use Summerhays's ruling to push back against open border activists and implement policies that will allow the Border Patrol to secure the border, something he has failed to do to this point in his administration. If there are any smart people in the White House, they will wake up and realize that although not wanted, Judge Summerhays's ruling is a boon, and they will urge the president to comply with the ruling completely.

Asylum vessel intercepted on way to Australia

I am a bit sympathetic to these people.  Sri Lanka is  an economic  disaster area at the moment  and these people are much more likely to be Sinhalese than Tamil Tiger sympathizers.  And Non-Muslim South Asians generally make good citizens

A vessel carrying Asylum seekers has been intercepted off Australia's coast.

The Prime Minister used his final media conference of the campaign to announce the boat had been intercepted on Saturday morning after making its way from Sri Lanka.

It is understood about 15 people were on board the vessel that was stopped by Australian authorities off the west coast of Christmas Island after almost making it to the mainland.

Those people were on Saturday afternoon on board an Operation Sovereign Borders vessel having their credentials verified.

As reported in The Weekend Australian today, Home Affairs Minister Karen Andrews said the Sri Lankan navy had intercepted a fishing vessel and two dinghies carrying dozens of people on Wednesday before Saturday’s development.

“This is not scaremongering, this is a reality and it has been demonstrated by the two attempts that we are aware of,” she told reporters at a press conference on Saturday.

“We don’t know if there are any other attempts that have been made over the last few days and we don’t know if there have been any deaths at sea.

“I’ve said very clearly on my watch that I wanted no people to be attempting to travel to Australia illegally by boat and I didn’t want any deaths at sea.

She said that the Labor government posed a risk to Australia’s borders because of its opposition to temporary protection visas, which are aimed at denying permanent resettlement.

Shadow Minister for Home Affairs Kristina Keneally said Labor supported Operation Sovereign Borders, calling people smuggling a “vile trade”.

“Labor supports Operation Sovereign Borders – offshore processing, regional resettlement, and boat turn-backs where safe to do so,” she said on Saturday.

“Labor thanks the Operation Sovereign Borders Joint Agency Task Force for their continued work at keeping our borders secure.”

NY Budget Spends $820M on Medicaid for Illegal Immigrants

New York Gov. Kathy Hochul recently signed into law a $220 billion budget riddled with wasteful spending, including $220 million for free Medicaid for illegal immigrants and a $600 million subsidy for a new Buffalo Bills stadium, according to the New York Post.

Federal law prohibits federal tax dollars from going toward Medicaid for illegal immigrants, so New York taxpayers will pick up the tab for free healthcare for up to 20,000 illegal immigrants living in the Empire State.

Those making less than $18,754 would qualify for the program, though many other details regarding eligibility have yet to be announced.

Dems advocate high immigration to gain political power — and smear Republicans when called on it

The horrific massacre in Buffalo has created a debate about great-replacement theory, the rancid idea that Jews are conspiring to destroy white America by importing non-white immigrants.

The Buffalo shooter was in thrall to the theory, as have been other racist and anti-Semitic killers.

The theory should be denounced by all people of good will, and indeed, it thrives only in the most sewerish precincts of the Internet.

Yet there is an attempt to tar Republicans more broadly with the theory and somehow attribute responsibility for the horror in Buffalo to them on this basis. The argument is that the likes of Elise Stefanik, a Republican congresswoman from New York, have warned that the Democratic Party views immigration as a way to change the electorate in its favor and so are mainstreaming the hateful replacement ideology.

This is a smear and especially perverse since Republicans sounding the alarm about this Democratic view have been unquestionably correct. There hasn’t been any secretive cabal at work — it’s all been out in the open, discussed by progressive political operatives and think-tank analysts and celebrated in the press.

The left-wing Center for American Progress issued a report in 2013 titled “Immigration Is Changing the Political Landscape in Key States.” It summarized its argument thus: “Supporting real immigration reform that contains a pathway to citizenship for our nation’s 11 million undocumented immigrants is the only way to maintain electoral strength in the future.”

Books were written about this idea. The widely cited (and over-interpreted) 2002 book “The Emerging Democratic Majority” by John Judis and Ruy Teixeira called the Democrats “the party of transition” as “white America is supplanted by multiracial, multiethnic America.” In 2016, Steve Phillips published “Brown Is the New White: How the Demographic Revolution Has Created a New American Majority.” His publisher’s website says the latest edition of the book contends “hope for a more progressive political future lies not with increased advertising to middle-of-the-road white voters, but with cultivating America’s growing, diverse majority.”

Donald Trump’s 2016 victory suppressed some of this sentiment since it made it clear that white working-class voters didn’t appreciate being spoken of as if they were a relic of the past, and the 2020 election and its aftermath made the assumption that Democrats will own Latino voters forevermore seem increasingly shaky.

But the left wants to create rules that define it as perfectly acceptable for Democrats to advocate high levels of immigration as a means of gaining political power and out of bounds for Republicans to call them on it.

Washington Post writer Greg Sargent slammed Stefanik for allegedly flirting with the great-replacement theory in Facebook advertisements last year. They warned that Democrats want a sweeping amnesty for illegal immigrants “to overthrow our current electorate and create a permanent liberal majority in Washington.”

Never mind that Stefanik could have drawn her warning directly from various left-wing writers and advocacy organizations. Or that Sargent himself wrote after Barack Obama’s victory in 2012 that the election had been “all about demographics” and the outcome showed the electorate wasn’t “reverting to the older, whiter, more male version Republicans had hoped for.”

What makes Sargent’s basic sentiment different from Stefanik’s, other than the fact that he welcomes how immigration trends have changed our politics and she doesn’t?

Immigration has been hotly contested throughout our history and is inherently a highly emotive issue, involving the composition of our polity and core questions of national identity. It can only inflame the issue further to explicitly weaponize demographic change, as the left has for decades now. We should have an immigration policy that serves the national interest, not the narrow interest of one political party.

Yes, by all means, further shun and marginalize great-replacement theory, but don’t support high levels of immigration for partisan reasons and expect the other side not to notice.

Biden Administration Sneaks Unlawful Immigration Benefits Into Ukraine Aid Request

President Joe Biden recently sent an emergency supplemental funding request to Congress for $33 billion in aid to Ukraine. However, the administration used the opportunity to sneak in unlawful immigration benefits for hundreds of thousands of Ukrainian, Afghan, and Russian immigrants—paid for by the American people and at the expense of lawful applicants who have been waiting years to properly immigrate to the U.S.

The emergency request includes $1.2 billion for the Department of Health and Human Services with a nod to the Department of Homeland Security’s Uniting for Ukraine program. This portion of the funding request includes robust and increased blanket immigration provisions for Ukrainians, Afghans, and Russians in the science, technology, engineering, and math—or STEM—fields.

One of the most curious categories mentioned is the Russian STEM professionals. With the ongoing conflict in Ukraine, it is surprising that the administration believes it will “benefit” U.S. national security interests to peel back employer-sponsor requirements and expedite an unlimited number of applications from this foreign adversary.

Normally, these Russian nationals would be subject to visa caps that would limit the number allowed to enter the U.S. each year. This certainly seems like the Biden administration’s latest radical, opportunistic attempt to get around those caps one country at a time. And to start with Russia is just national security incompetence.

As far as refugees from Ukraine are concerned, of course, they are trying to escape a terrible crisis, and we should absolutely support the country’s efforts to combat Russia’s invasion. However, that does not mean that Biden or his Department of Homeland Security should get a free pass to once again disregard our nation’s immigration laws.

Just as the Biden administration did with Afghan evacuees, it is wildly abusing the humanitarian parole system for Ukrainians.

Humanitarian parole allows people who might not normally be eligible for admission into the United States to be in the U.S. for a temporary period for urgent humanitarian reasons. Parole was always meant to be used rarely, with strict grounds of inadmissibility in mind, on a case-by-case basis, and for a temporary period of time. Not so under the Biden and other Democrat administrations.

Biden’s funding request also specifically states that Ukrainian nationals will be eligible for parole and the associated benefits even after a September 2023 deadline if they are found to be a “parent, legal guardian, or primary caregiver of an individual who is determined to be an unaccompanied child.”

This will in effect encourage some parents, guardians, or even anyone loosely deemed a “caregiver” to endanger children and send them to the U.S. unaccompanied so they have a way of coming over later.

These provisions set forth by the administration do not only circumvent U.S. law and set dangerous precedents, they are also not the best solution for those they purport to help.

Encouraging a large group of Ukrainian citizens who are not otherwise eligible to live in the U.S. to travel halfway around the world instead of taking temporary refuge in a neighboring country to Ukraine hardly makes sense.

European Union nations have offered Ukrainians up to three years of residence with “access to employment and social welfare.” This enables them to easily return to Ukraine when they feel it is safe, and over a million people have already done just that. This solution is a far more logical, truly humanitarian option for citizens of Ukraine and will help to ensure that people can go back to rebuild their country when the fighting ends.

Biden’s supplemental request additionally includes opportunistic provisions placing Afghans on an expedited pathway to citizenship through green cards. With close to 80,000 largely unvetted Afghans having been evacuated to the U.S. in mid-2021 due to Biden’s abrupt departure from their country, we can only imagine how much worse of a strain on the system this will create.

Of course, strain on the system and a dismantling of the laws in place is exactly what Biden and his administration’s open-borders activists want. This emergency funding request is a clear effort to pack in as many new, unlawful immigration benefits as possible where Americans may not immediately expect to find them.

With the Biden border crisis at the southern border continuing full speed ahead, it’s well past time for the Biden administration to do something—anything—that actually follows the law and alleviates the intense pressure on our immigration system and our communities.

Since the administration seems unlikely to do anything like that, Congress would be prudent to carefully review this emergency funding request and reject the president’s attempts to increase unlawful immigration.

When the governing elite ignore the people

Large majorities  of the population in countries like the USA and Australia consistently say that immigration needs to be cut back -- particularly immigration from Muslim and Third world countries. The governing elite simply ignore that wish.

So it is pretty inevitable that there will be some people who attempt to do what the elite will not.  Such people have no power to expel those they disapprove of so do the one thing they can do:  shoot

The Buffalo supermarket killer says he was driven to kill by the ‘great replacement theory’ which claims white people are being driven to extinction by migrants.

Payton Gendron’s 180 page Google Drive document detailed his twisted reasons for carrying out Saturday's massacre at the Top Market supermarket, killing 10.

A large part of the manifesto focused on the 'great replacement theory'. IT claims whites are being deliberately outnumbered in the US by migrants from other countries to skew elections in favor of the Democrats.

The manifesto said that he'd been radicalized entirely by the internet - rather than anyone he'd met in real life - and added that he’d been inspired by Brenton Tarrant.

Tarrant is a white supremacist who live-streamed himself murdering 51 Muslims at a mosque in Christchurch, New Zealand, in 2019.

Gendron said: 'The truth is my personal life and experiences are of no value.'

Gendron said Tarrant ‘radicalized him the most’ while discussing what had spurred him to shoot 13 people, 10 of them fatally.

Police said 11 of the people he shot were black, with the other two white.

Federal judge expected to rule on Title 42 lawsuit within days as border crisis rolls on

A federal judge is expected to determine the fate of the Biden administration’s plan to lift Title 42 within days in response to a lawsuit brought by two dozen Republican states that claims lifting the public health order will lead to a bigger crisis at the southern border.

Judge Robert Summerhays of the Western District of Louisiana heard arguments Friday about the request for a preliminary injunction on the Biden administration’s plan to end Title 42 May 23.

The public health order, enacted in March 2020 due to the COVID-19 pandemic, has been used by both the Trump and Biden administrations to expel a majority of migrants at the southern border.

Republicans and some Democrats have warned that the already massive numbers of migrants being encountered at the border could surge if the order is lifted. It will also lead to significantly more migrants being released into the country, they say. The Department of Homeland Security has acknowledged this possibility, saying it is preparing for up to 18,000 migrants a day once the order drops.

States led by Arizona, Missouri and Louisiana sued, claiming the move by the Centers for Disease Control to lift the order violated the Administrative Procedures Act, which requires a notice-and-comment period and also bars moves deemed "arbitrary and capricious."

The lawsuit claims the administration failed to estimate or account for the costs to the states. They cite "increased health care costs for aliens infected with COVID-19 and the cost of increased illegal immigration caused by the Termination Order and the presence of much greater numbers of paroled aliens with non-meritorious asylum claims who were induced to enter the United States because of the Termination Order."

"This suit challenges an imminent, man-made, self-inflicted calamity: the abrupt elimination of the only safety valve preventing this administration’s disastrous border policies from devolving into an unmitigated catastrophe," the complaint states.

The states are seeking a preliminary injunction but have already won smaller victories in a related push for a temporary restraining order to stop the Biden administration from transitioning away from Title 42 expulsions and instead using expedited removal as the May 23 date approaches.

Summerhays granted the temporary restraining order last month and extended it earlier this week.

Attorneys for the Justice Department argued Friday that the CDC was within its authority to lift an emergency health restriction it felt was no longer warranted at this stage of the pandemic, reiterating that Title 42 is a health policy, not an immigration measure.

"There is no basis to use Title 42 as a safety valve," the DOJ's Jean Lin told Summerhays.

Activists on both the right and the left believe that Summerhays, a Trump nominee, is likely to rule in favor of the Republicans who sued, meaning Title 42 will remain in place as the busy summer months at the border arrive.

There were 221,000-plus migrant encounters in March, and that number is expected to have risen in April. Customs and Border Protection (CBP) has not yet released figures for April.

"The Biden administration has little concern for maintaining public safety and even less for following administrative procedures," Arizona Attorney General Mark Brnovich said in a statement after the arguments. "Our coalition of state attorneys general will continue fighting to preserve Title 42 with the hope of maintaining some accountability and sanity at our southern border."

Several immigrant activist groups have asked Summerhays to allow Title 42 to be lifted as planned in California and New Mexico, two states not included in the lawsuit. But the Republican states have sought an injunction that would be applied nationwide due to the national implications of the policy.

Such a ruling may relieve the Biden administration of a difficult political situation. It is facing pressure from Republicans as well as moderate Democrats, some of whom are in tight re-election races, who have signed onto legislation to delay Title 42 until 60 days after the CDC ends the national emergency.

In the meantime, the Biden administration has been touting its plan to surge resources to the border and move more migrants to expedited removal. So far, it does not appear to have swayed many moderate Democrats on the matter.

Lifting Title 42 Will Mean Fewer Border Patrol Agents in Field

McALLEN, Texas—Border security experts expect the nation will bear the consequences of more illegal immigration whether the Biden administration ends a key public health measure by the end of the month or does it later.

The Centers for Disease Control and Prevention announced last month that the policy, known as Title 42, would expire May 23. President Joe Biden’s Department of Homeland Security has estimated that could mean an influx of 18,000 migrants a day who cross the border illegally.

“There are too many Democrats pushing back, too many Democrats terrified of the consequences, because the [Department of Homeland Security] itself, Biden’s DHS, was predicting a doubling or more of the flow across the border if they lifted Title 42,” Mark Krikorian, executive director of the Center for Immigration Studies, told The Daily Signal in a recent interview.

“But it is going to be lifted at some point,” Krikorian said of Title 42.

Sens. Gary Peters, D-Mich., and Mark Kelly, D-Ariz., are among the most vocal Democrats calling for the Biden administration to keep the public health policy in place.

Title 42 is a provision of a 1944 law meant to stop the spread of communicable disease. The provision allowed the Centers for Disease Control and Prevention to take emergency action in March 2020, during the early stages of the COVID-19 pandemic, to authorize border authorities to quickly expel illegal immigrants and deny entry to asylum-seekers.

Although the measure hasn’t stopped huge numbers of illegal immigrants from crossing the southern border and immediately claiming asylum, it has made it easier for the Border Patrol to send back illegal aliens.

‘Enormous Pressure From Left’
Once Title 42 is gone, unlawful border crossers will have the right to have their asylum claims adjudicated on American soil.

“Unless Congress intervenes and passes a law saying they can keep it in place and the president signs it, it just seems to me it’s going to have to be lifted at some point because the president is also getting enormous pressure from this hard left,” Krikorian told The Daily Signal.

“When they do that,” he added, “it’s going to be bad news on the border and it’s going to be worse news for the Democratic Party, because the more they keep delaying it, the closer and closer it gets to the election.”

The Center for Immigration Studies, which advocates strict enforcement of the nation’s immigration laws and opposes amnesty for illegal immigrants, organized a visit to the border in South Texas last month that The Daily Signal joined.

Homeland Security Secretary Alejandro Mayorkas met Tuesday in Washington with Mexican Foreign Minister Marcelo Ebrard.

Mayorkas “spoke of the United States’ whole-of-government strategy to prepare for the CDC’s announced May 23, 2022, end to the exercise of its Title 42 authority,” according to the department’s readout of the meeting.

Expulsions Under Title 42

After the CDC invoked Title 42, the Border Patrol had about 2.9 million encounters with illegal immigrants at the U.S.-Mexico border between April 2020 and March 2022, according to a study by Pew Research. March is the most recent month for which such data is available.

About 1.8 million of those encounters, or 61%, resulted in illegal immigrants being expelled under Title 42, according to Pew. The 1.1 million remaining encounters ended with illegal immigrants being detained, at least temporarily, rather than sent back.

Expulsions were based largely on whether the migrants came as families and whether children were involved.

Under the Biden administration, about 88% of the 1.8 million expulsions since 2020 under Title 42 were of single adults, while 11% were families and 1% were unaccompanied minors.

About 60% of those expelled came from Mexico, 15% came from Guatemala, 14% from Honduras, 5% from El Salvador, and 6% from other countries, according to Pew.

COVID-19 isn’t the only public health concern to consider, said Chris Cabrera, spokesman for the union National Border Patrol Council Local 3307, which represents nonsupervisory Border Patrol employees who work in the Rio Grande Valley.

“It’s to the point where everybody I work with, every single person, has had COVID,” Cabrera told a group gathered in Texas for the border tour sponsored by the Center for Immigration Studies.

But, the union spokesman said, some Border Patrol agents have contracted communicable diseases while policing the border that doctors have had trouble diagnosing.

‘Spinning Your Wheels’

If Title 42 ends, it will bring more chaos to the southern border, said Michael Salinas, a retired Border Patrol agent who was on the front lines for 34 years.

“Pretty much, there’s going to be nobody out in the field,” Salinas told The Daily Signal.

“The Border Patrol knows where they’re at,” the veteran agent said of these so-called got-aways. “But if they don’t have access to it because they’re stuck processing or prepping people for transport to processing centers, it takes away from all that. So you’re just spinning your wheels.”

The Center for Immigration Studies’ Krikorian said he expects that Biden and congressional Democrats will try to kick the can down the road, but that it can’t go on forever.

Events may depend on what faction in the Biden administration prevails, he said:

There are two factions in the administration on this immigration issue. They both believe the same thing. In other words, everybody in the administration wants basically amnesty for all the illegals and unlimited immigration in the future, and all that stuff. It’s not really at all a policy dispute, it’s a political dispute.

Krikorian said White House chief of staff Ron Klain and Susan Rice, director of the Domestic Policy Council, are trying to take a more politically acceptable approach to illegal immigration in the short term.

“The people like Ron Klain and Susan Rice, who are at least a little bit more in touch with reality … the point is they’re more cautious politically,” Krikorian said. “But then everybody who’s in charge of immigration policy are radicals. They’re anti-borders radicals.”

11 dead, 31 rescued as suspected migrant boat capsizes near Puerto Rico

At least 11 people were killed and 31 rescued when a boat full of passengers capsized north of Puerto Rico Thursday, officials said.

Eight Haitians were among those saved and hospitalized during a “mass rescue effort” led by the US Coast Guard.

It was unclear how many people were on the capsized vessel, which was first spotted by a US Customs and Border Protection helicopter about 11 miles north of the uninhabited Puerto Rican island of Desecheo, according to authorities.

“We’re looking to rescue as many people as we can and find as many survivors as we can,” US Coast Guard spokesman Ricardo Castrodad said, adding it was fortunate that officials spotted the overturned boat.

“If not for that, we would not have known about this until someone would have found any sign or received reports from people that their loved ones are missing,” Castrodad said. “They found them early enough that we were able to coordinate a response.”

The disaster came after a string of migrant boats transporting people fleeing Haiti and the Dominican Republic capsized in the waters around Puerto Rico and the US Virgin Islands.

On Saturday, officials rescued 68 migrants in treacherous waters between Hispaniola and the US territory. One Haitian woman died, according to Castrodad.

More than three dozen migrants were presumed dead off the coast of Florida in January when a smuggling boat from the Bahamas was flipped over in a storm.

In excess of three thousand migrants from the Dominican Republic, Haiti and Cuba were detained by the Coast Guard in the Caribbean Sea and Atlantic Ocean in the 2021 fiscal year, according to the feds.

“These voyages are dangerous,” Castrodad said. “They’re unsafe, they are grossly overloaded … (and) no lifesaving equipment. It wouldn’t really take much for any of these vessels to capsize.”

'Alien always wins rule:' Biden invents new way to keep illegals in country with circular process

Facing mounting losses in the courts over its immigration policies, the Biden administration has invented a new tactic for keeping as many illegal aliens in the country as possible: Create a circular bureaucratic process loop indefinitely delaying deportation.

The newest tactic was exposed last week in a lawsuit filed by Texas Attorney General Ken Paxton challenging obscure regulatory changes by the Homeland Security Department that shifted the power to deport away from immigration judges to civilian bureaucrats while allowing aliens multiple means of delaying and appealing.

"The Interim Rule sets forth all kinds of exceptions from the procedures and timelines in the new regulations, generally always inuring to the alien's benefit," Paxton wrote in his lawsuit.

"In summary, the Interim Rule transfers significant authority from immigration judges to asylum officers, grants those asylum officers significant additional authority, limits immigration-judge review to denials of applications, and upends the entire adjudicatory system to the benefit of aliens," the suit added.

The vast majority of asylum cases that reach an immigration judge are rejected, about 71% of the time under President Trump, though it fell to 63% in the first year of the Biden presidency. And most aliens are then subjected to expedited removal.

What the Biden administration did is create interim rules that significantly bypass the immigration judges, allowing civilian bureaucrats working for the Customs and Immigration Service to take new actions that delay or circumvent expedited removal.

The Texas lawsuit noted several of the changes, including that "individuals subject to expedited removal and found to have a credible fear of persecution or torture would have their claims for asylum, withholding of removal ... or Convention Against Torture ... protection initially adjudicated by USCIS following a nonadversarial interview before an asylum officer."

Aliens who lose at the immigration court level now can appeal and and get reconsidered by the CIS bureaucracy under most favorable conditions, the Texas suit noted. And aliens who lose at both the court and CIS level and facing "expedited removal proceedings would be eligible for consideration for parole."

John Zadrozny, a former White House immigration adviser to President Trump, told Just the News the new rules have simply created a circular bureaucratic process with little end in sight, meaning most aliens who enter it can stay in America indefinitely for years.

"What this rule basically does is it destroys expedited removal for all intents and purposes, and creates an endless loop of review that will prevent an alien from really ever being removed under the expedited removal process," Zadrozny explained during an interview Monday on the John Solomon Reports podcast.

"We're calling this the 'Alien always wins rule,' because that's basically what it is: It's designed to prevent them from [ever] getting a final negative adjudication" authorizing their removal from the country," Zadrozny said.

Paxton said his 11th lawsuit since 2021 challenging Biden immigration policies — many of which have already prevailed — is designed to challenge a process that leaves illegal aliens in the driver's seat to stay in the country.

"The last thing Texas needs is for this Administration to make it easier for illegal aliens to enter the U.S. and obtain asylum through false claims and less oversight," Paxton said.

"We know what's going to happen when the rule goes into effect in May 2022: wave upon wave of illegal aliens claiming 'asylum.' It's true that our immigration system is extremely backlogged. But the answer is to secure the border, not overwhelm it even more by enacting cheap, easy incentives for illegal aliens to get into the United States."

Florida Immigration Lawsuit v. Biden Can Go Forward, Judge Says

A federal judge ruled on May 4 that a lawsuit filed by Florida Attorney General Ashley Moody over “catch and release” of undocumented immigrants can move forward, rejecting the Biden administration’s motion to dismiss it.

U.S. District Judge Ken Wetherell denied the motion filed by the U.S. Department of Justice to dismiss Moody’s case that was filed last year.

The lawsuit alleged that the Biden administration had violated immigration laws through policies that have led to people being released from detention after crossing the U.S. border with Mexico. Also, it alleged that the releases affect Florida because of the negative impacts on education, health care and criminal justice services.

The Justice Department attorneys contended that the Biden administration has a “non-detention” policy.

However, Wetherell, formerly a state appeals court judge, ruled that the lawsuit should continue to move forward.

In the 37-page decision, the judge made blistering remarks about the Biden administration’s policies.

“Suffice it to say the court is wholly unpersuaded by defendants’ position that they have unfettered discretion to determine how (or if) to comply with the immigration statutes and that there is nothing that Florida or this court can do about their policies even if they contravene the immigration statutes,” Wetherell wrote. “This position is as remarkable as it is wrong because it is well established that no one, not even the president, is above the law and the court unquestionably has the authority to say what the law is and to invalidate action of the executive branch that contravenes the law and/or the Constitution. Thus, if Florida’s allegations that defendants are essentially flaunting the immigration laws are proven to be true, the court most certainly can (and will) do something about it.”

Moody has joined other states’ lawsuits as well as filed her own, challenging the policies of the Biden administration and publicly criticizing the policies that are allowing mass migration on the southern border.

“Congress has not given immigration officials unbounded discretion regarding the detention of arriving aliens,” the state’s lawyers wrote in a March court document. “It has instead expressly commanded those officials to detain arriving aliens.”

On the other hand, the federal government contends that officials have “discretion in carrying out immigration laws.” They list a number of issues such as limited detention space, humanitarian reasons, and prioritization of resources and say that “Florida lacks legal standing to pursue the case.

“In particular, plaintiff hypothesizes that paroled noncitizens might settle in Florida and, if so, then might commit crimes or require social services,” the federal government argued in a court document filed in April. “Plaintiff’s predictions are too attenuated and uncertain to provide standing. If such incidental, conjectural consequences were sufficient … the federal courts could be drawn into every immigration policy dispute between a state and the federal government. Plaintiff’s theory would characterize any increase of noncitizens within its borders necessarily as an injury.”

Wetherell, appointed by then-President Trump refused to dismiss the case, as he wrote in his decision:

“Florida has plausibly alleged that the challenged policies already have and will continue to cost it millions of dollars, including the cost of incarcerating criminal aliens and the cost of providing a variety of public benefits, including unemployment benefits, free public education and emergency services to aliens who settle in Florida after being ‘paroled’ into the country.”

Wetherell said in his decision that he had not discounted the federal government’s argument that “Congress has authorized it to establish immigration enforcement policies and priorities, specifically those related to allocating its limited resources, thereby conveying discretion.”

“However, Congress was presumably aware that defendants have limited resources when it enacted the detention requirement, yet it still chose to use language mandating detention,” he wrote in his decision. “Even if resource allocation and other policy priorities can be considered in defendants’ exercise of their limited parole authority … those considerations do not give defendants carte blanche to release arriving aliens without undertaking individualized case-by-case assessments as required by that statute, as they have allegedly done through the challenged policies—particularly if, as Florida alleges, defendants have essentially created the problem the challenged policies seek to alleviate.”

Sen. Johnson rips the hairless horror over lax border security, says he’s aiding ‘evil people’

Sen. Ron Johnson ripped Homeland Security Secretary Alejandro Mayorkas over the administration’s immigration policies, saying he is abetting “some of the most evil people on the planet” by failing to secure the southern border.

“He had no idea on the numbers of all the human depredations caused by his administration facilitating the business model of some of the most evil people on the planet: The human trafficking. The sex trafficking. The drug trafficking,” Johnson (R-Wisc.) told host John Catsimatidis on his WABC 770 AM radio show in an interview that aired Sunday.

“He is completely oblivious to it,” the senator said.

Johnson said the first thing President Biden and Mayorkas must do is acknowledge there is a problem at the border.

“It is enormously frustrating. [Biden and Mayorkas] will never solve the problem if they won’t first admit they have one … and if they won’t acknowledge the root cause. And … the root cause of the problem is President Joe Biden and Secretary Mayorkas,” he said.

Johnson said the Biden White House and the administration of former President Barack Obama have been a disaster for Americans.

“Obama and Biden [said] they were fundamentally going to transform America. Now Americans are starting to understand what that looks like: Open borders. 40-year-high inflation. Record gasoline prices. Rising crime. They’re fundamentally destroying this country,” Johnson said.

The media and big-tech, he said, are complicit in hiding the failures of those administrations.

“They got [Biden] elected — a man who campaigned from his basement.  They covered up the Hunter Biden … laptop story. That was all censored. The corruption of the media in all of this also has to be pointed out. That is one of the reasons they … get away with the … out-of-control border crisis. The mainstream media is not reporting on it,” he said.

After The Post’s expose on Hunter Biden’s foreign business dealings, based on information found on the first son’s abandoned laptop in October 2020, Twitter blocked the tabloid from sharing the articles for more than two weeks before relenting.

All the President's Border Policies That Have Illegals Heading North

While a federal court has stayed the Biden administration’s attempt to lift pandemic-prompted restrictions on immigrants pouring across the southern border, that is just one setback in a largely successful push by the president to make it easier for migrants to enter, live, and work in the U.S.

Since Joe Biden’s first day in office, when he signed seven executive orders on immigration that, among other things, suspended deportations and ended the Trump administration’s “Remain in Mexico” program that had eased the crush of those awaiting asylum hearings, the president has in word and deed sent signals that migrants have interpreted as welcoming. The initiatives include reviving the Obama-era policy known as “catch and release,” “paroling” illegal border crossers so they can enter the country, resettling migrants through secret flights around the country, and ending the “no match” policy that had helped the government identify people who were using fraudulent credentials to find work.

At the same time, the administration has deflected responsibility for the surge of immigrants. Initially, Biden’s team claimed there was no significant spike in immigration, later attributing it to “cyclical” and seasonal trends. Even as a record number of migrants from around the world were streaming across the border, White House Press Secretary Jen Psaki declared last year that “the border remains closed.” Last week, Secretary of Homeland Security Alejandro Mayorkas said the administration had “effectively managed” the border crisis while also blaming “a broken and dismantled system” the administration had inherited.

Many people on the front lines of the border – where a record 1.9 million people were apprehended during fiscal 2021, hundreds of thousands of whom were then released into the country – say the Biden administration’s policies have exacerbated the surge.

“We’re stopping nobody coming into our country,” said Clint McDonald, the executive director of the Texas/Southwestern Texas Border Sheriffs’ Coalition, “and we have no idea who is in our country.”

McDonald and other critics blame what they see as an ideological crusade by Biden officials to dissolve or ignore various laws and regulations that once checked or limited the influx of illegal immigrants – whom the administration now refers to as “irregular migrants.”

“We don’t know how else to put it,” said Spencer Raley, the director of research for the Federation for American Immigration Reform, which favors curbs on illegal immigration. “Since the day he took office, Biden has not signed a policy that would enhance border security. Instead, everything that has been put into place was designed not just to undo policies of the Trump administration but to reflect an unending desire to bring more and more people into our country.”

Biden’s presidential campaign was perhaps more transparent about his intentions than the official line since his inauguration. At several points in 2020, the campaign signaled that enforcement of the U.S. border would be significantly relaxed and opportunities for amnesty expanded. Criticism of the Trump administration’s allegedly harsh border policies were a staple of Biden and his fellow Democratic Party candidates throughout that election year.

Within hours of taking office Biden began to make good on his signals, moving aggressively against the existing infrastructure that dealt with illegal immigration at the southern border. In addition to temporarily suspending deportations and ending the “Remain in Mexico” program, he issued an executive order stopping work on Trump’s border wall. Policy memos from the Homeland Security also gave Customs and Border Protection and ICE agents more latitude in how they handle people encountered crossing the southern border without papers. These policy directives effectively ended ICE’s usual practice of taking custody of immigrants released from local or state jails, and placed more restrictions on the ability of federal authorities to arrest illegal immigrants.

During Trump’s last three months in office, apprehensions along the southern border held steady at an average of 75,000. In the first two months of Biden’s tenure, that number shot up by 120%, reaching a peak of 213,593 last July.

Despite those sharp increases, the Biden administration continued its relaxed border policies. Agreements the Trump administration had reached with Mexico and Central American countries, known as Asylum Cooperative Agreements, which were designed to constrict the flow of immigrants, were scrubbed so that immigrants no longer needed to request asylum in the first country they enter after leaving home.

The administration also reinstituted an Obama-era policy known as “catch and release.” It moved in the opposite direction of the Trump administration by lifting travel bans on some countries – bans upheld by the Supreme Court. Biden’s team has also expanded the list of countries whose residents can be granted “Temporary Protected Status” – which prohibits deportation because those countries are deemed unsafe – and extended the safe harbor period for residents of nine covered countries. The Pew Research Center estimated last year that at least 700,000 immigrants from 12 countries were covered by the program, including Haiti, El Salvador, Venezuela, and Yemen.

The Biden administration has once again expanded the ability of Border Patrol and ICE agents to grant illegal immigrants what is known as “parole.” Although the law granting this power is specific – it allows the government to temporarily admit people on a “case-by-case basis for urgent humanitarian or medical reasons” – various administrations have interpreted the law differently. The Biden administration has reversed Trump’s strict interpretation of that language, reverting to the policy in place under President Obama that allows much wider discretion for granting of “parole” to accept hundreds of thousands of migrants.

Some states have challenged the Biden administration’s expansion of parole, although those cases are still being litigated.

In yet another policy change that facilitates illegal immigration, the Social Security Administration quietly announced on its website last May that it would cease to issue what are known as “no-match” letters, which informed employers of discrepancies between its records and information provided by employees. Critics of the system said it targeted immigrants and claimed the letters were often sent in error. The SSA reportedly sent 791,000 no-match letters in 2020.

The Biden administration has even further euphemized liberals’ use of language regarding immigration. Advocates of more open border policies long preferred “undocumented aliens” to “illegal immigrants,” but now even that has been abandoned for the new phrase, “irregular migrants.”

RealClearInvestigations reached out to the Department of Homeland Security, its subordinate organizations of Customs and Border Protection and ICE, and the SSA for comment on the overall impact of Biden administration policies, but did not receive a response. An ICE spokesperson responded that it would defer to CBP, which did not respond.

Most recently, the Biden administration insisted on ending Title 42, a clause from a 1944 public health law the Trump administration had used to limit illegal immigration during the COVID pandemic. Experts predicted its removal would lead to a tsunami of more illegal immigrants, and at least 10 congressional Democrats, including those up for reelection this year such as Georgia Sen. Raphael Warnock, have voiced reservations about lifting it.

When pressed last month on the reasoning behind the plan to do away with Title 42, White House spokesperson Vedant Patel said: “As always is the case, this administration is working every day to provide relief to immigrants, restore order, fairness and humanity to our immigration system and bring it into the 21st century.”

Critics such as Raley of the Federation for American Immigration Reform say such language shows that Biden’s team sees the issue from the perspective of migrants rather than that of American citizens. “They’re changing the terms because they want to conflate illegal immigrants at the southern border with legal immigration,” he said.

Although there have been rumblings that Republicans might move to impeach Mayorkas if they regain the House next year, most of the pushback to the administration’s immigration policies has come from the states. Various lawsuits filed by Texas, Louisiana, Ohio, Arizona, Alabama, and Montana have sought to check ICE’s refusal to take custody of immigrants released from prison, and another suit this week seeks to block the administration’s plan to give asylum granting powers to U.S. Citizenship and Immigration Services employees rather than immigration court judges.

The administration claims the new rule would “streamline” the process and help unclog a huge backlog in immigration court of nearly 1.7 million cases, according to a recent study by a team at Syracuse University.

Lawyers for the state of Texas contend, however, that the rule violated the Administrative Procedures Act and unduly shifts power from immigration courts to UCIS workers. Their lawsuit argues that the proposed rule “upends the entire adjudicatory system to the benefit of aliens,” the lawsuit said.

In some instances, most recently with the effort to lift Title 42, the Biden administration has been rebuffed in court – as it was last year, when a federal appeals court rejected its effort to end the “Remain in Mexico” policy. The Supreme Court heard arguments on that case last month.

The impact of the administration’s policies is clear to would-be migrants around the world, Sheriffs’ Coalition leader McDonald said. “There is a widespread idea among them that the border is open,” he told RCI. “Last week, illegal immigrants on the Rio Grande wanted to take pictures with sheriff’s deputies they encountered. They were FaceTiming people back in their home countries shouting, ‘We’re here! You can come!’ They know our government is not going to do anything about it.”

McDonald spent 21 years as sheriff of Terrell County, Texas, and when he first won his badge he said that perhaps two corpses a year would be found along the border. Last year it was 22. “It’s just unreal,” McDonald said. “Some of these small counties can’t even cover their morgue bills anymore.”

Biden’s Homeland Security Chief ‘Should Be Ashamed,’ Union Leader Says

McALLEN, Texas—President Joe Biden and his homeland security chief have pushed policies that have made life easier for cartels smuggling drugs and illegal immigrants across the southern border, a top Border Patrol agent in Texas says.

Chris Cabrera, who is also spokesman for the National Border Patrol Council Local 3307, helps patrol the Rio Grande Valley, which is among the most overwhelmed areas near the southern border.

Cabrera says he is withholding judgment on whether Homeland Security Secretary Alejandro Mayorkas should be impeached over the border crisis, but does say Mayorkas “should be ashamed.”

The Biden administration reversed many of the Trump administration’s border security policies by halting deportations, stopping construction of the border wall, and ending the “Remain in Mexico” policy requiring asylum-seekers to make their claims from the other side of the border until they may be adjudicated.

“It has made [the cartels’] job a whole lot easier,” Cabrera said in response to a question from The Daily Signal, as he spoke to a group visiting the southern border as part of a tour organized by the Center for Immigration Studies, a think tank that advocates strict enforcement of immigration law.

Late last month, Mayorks released a “comprehensive” plan that he touted for having “six pillars,” including surging resources to the border, working with charitable organizations, and targeting human smugglers.

“That’s an immigration plan. That has nothing to do with security,” Cabrera told The Daily Signal. “He’s coming out with this, ‘Oh, we’re going to do this and we’re going to do that.’ But that has nothing to do with stopping the flow of people coming across [the border].”

White House press secretary Jen Psaki told reporters Wednesday that White House officials are working with the Department of Homeland Security to implement the plan.

“Secretary Mayorkas testified and laid out six very specific pillars of effort and work that we would be pursuing, and some of that would be working directly with countries in terms of addressing root causes, addressing actions or attempts by smugglers to take advantage of this moment, and working with the Mexican government as part of that,” Psaki said.

Local 3307 represents nonsupervisory Border Patrol employees who work in the Rio Grande Valley sector.

Someone in the tour group asked Cabrera whether the union has or would take a stand on a potential Mayorkas impeachment, which Republican lawmakers have talked about on Capitol Hill.

“I don’t think they have,” he responded, adding that the union doesn’t approve of the job Mayorkas is doing.

“Honestly, he should be ashamed of himself,” Cabrera said of Biden’s homeland security secretary. “In private, he says one thing; in public, he says another.”

Privately, he said, Mayorkas would tell Border Patrol agents that “he’ll fight for us and do everything he can, he’s working on our behalf.”

But then, the union spokesman said, “he goes out in public and calls us racists.”

“I think he’s just a yes man,” Cabrera said of Mayorkas. “He’s going to say what they tell him to say.”

The Border Patrol station in McAllen is among the largest in the nation, with more than 600 assigned agents compared with about 40 at most stations, Cabrera said.

Still, he said, the McAllen station doesn’t have enough resources to handle the transnational criminal smuggling organizations.

This situation has taken a toll on the town of McAllen and the Rio Grande Valley as far as economic development goes, the union spokesman said.

“It’s not a bad place to live, but find any other metropolitan area that has a major body of water—a river, a lake, an ocean—that doesn’t have million-dollar houses,” Cabrera told the tour group. “I know one, and it’s right here.”

He also criticized the administration’s investigation of Border Patrol agents in Del Rio, Texas, who Biden on Sept. 24 publicly accused of having “strapped” illegal immigrants from Haiti who were trying to cross the Rio Grande.

Biden, Mayorkas, Vice President Kamala Harris, and other Democrats suggested or insisted that Border Patrol agents on horseback had “whipped” asylum-seekers.

“I think it’s complete and utter nonsense,” Cabrera said of the investigation when asked about it, adding:

You have two different types of ways of riding a horse. You have Western riding, like what you see down here. And you have those guys with little black hats. … I guess they do English riding. Down here, you use those reins to control where the horse is going.

The investigation by the Department of Homeland Security’s Office of Inspector General cleared the agents, but the resulting report still hasn’t been made public, he noted. From the beginning, a photographer who took photos of the episode said agents weren’t using whips.

“Any time the Border Patrol does anything, it’s looked at with a microscope,” Cabrera said.

The agents involved in the September incident are allowed into the field, but not on horseback, the union spokesman said. He said he expects the report will be released eventually, and that the agents were treated unfairly.

“These guys didn’t have a prayer because … the president comes out and says, ‘You’re going to pay’ and the secretary says, ‘Hey, you were wrong,’” Cabrera said.

Amid Vetting Failures, Green Cards for 85K+ Afghans

President Joe Biden is seeking to provide green cards to tens of thousands of Afghans who were quickly resettled in American communities over the last eight months amid a federal investigation that found many have possible ties to terrorism and were not properly vetted.

The quasi-amnesty plan is slipped into a funding request where Biden is asking Congress to approve $33 billion in American taxpayer money to send to Ukraine.

As part of the plan, Afghans given humanitarian parole by the Biden administration would be allowed to adjust their immigration status to obtain lawful permanent residence, otherwise known as a green card. After five years of holding a green card, the Afghans would be able to apply for naturalized American citizenship.

“The Secretary of Homeland Security, in the Secretary’s discretion, may adjust the status of an Afghan national … whose parole has not been terminated, to that of an individual lawfully admitted for permanent residence provided that the Afghan national,” the plan states.

Dan Stein with the Federation for American Immigration Reform (FAIR) said in a statement that the plan is simply another effort by Biden “to blow holes in our already crippled immigration system.”

“These are not people who lent material support to U.S. forces during the 20 years we spent in Afghanistan,” Stein said. “Rather, many are random people who arrived in the United States after the Taliban takeover, and were admitted under the Biden administration’s widely abused power of parole.”

Biden has resettled more than 85,000 Afghans in American communities across 46 states since mid-August 2021 and plans to continue resettling tens of thousands of Afghans throughout the year while asking Congress to authorize the resettlement of Afghans for the next decade.

The resettlement failed to properly vet Afghans against counter-terrorism databases, the Department of Defense’s Inspector General revealed in an explosive investigation in February.

As of November 2021, the report states that 50 Afghans already in the U.S. have been flagged for “significant security concerns.” Most of the unvetted Afghans flagged for possible terrorism ties have since disappeared in the U.S. In one instance, only three of 31 Afghans flagged months ago for security concerns could be located.

The resettlement was first authorized by 49 House and Senate Republicans, who joined Democrats in September 2021 to fund the resettlement to the sum of $6.4 billion. Then, in December 2021, 20 House and Senate Republicans helped Democrats pass an additional $7 billion in funds to ramp up the endless Afghan migration.

Refugee contractors, the non-governmental organizations (NGOs) that rely on American taxpayer money to resettle refugees across the U.S. annually, secured billions as a result of the funding measures.

Every five years, refugee resettlement costs taxpayers nearly $9 billion. Over the course of a lifetime, taxpayers pay about $133,000 per refugee, and within five years of resettlement, roughly 16 percent will need taxpayer-funded housing assistance.

Over the last 20 years, nearly a million refugees have been resettled in the nation — more than double that of residents living in Miami, Florida, and it would be the equivalent of annually adding the population of Pensacola, Florida.

Biden’s Open Border Chief Gets Hill Drubbing

On its very first page, President Joe Biden’s new border security plan admits that it will lead to increased illegal immigration “as smugglers will seek to take advantage of and profit from vulnerable migrants.”

In a sane world, plans that benefit human smugglers would be scrapped. Instead, amid the worst border crisis in U.S. history, the administration is plowing full steam ahead to remove the last remaining major line of border defense: Title 42, which is scheduled to expire on May 23.

Under Title 42 authority, single adults and families illegally crossing the border may be expelled immediately to protect citizens from the spread of COVID-19. In March, 221,303 illegal aliens crossed our southern border, the most in over two decades. About half were expelled under Title 42. You don’t need an advanced math degree to figure out what happens when Title 42 goes away.

Despite bipartisan calls to keep Title 42, Homeland Security Secretary Alejandro Mayorkas this week issued a vague 20-page document outlining how his department plans to deal the anticipated surge in border-crossings—expected to reach 18,000 per day. The plan boils down to this: process illegals into the interior as quickly as possible with the help of taxpayer funded, open-borders non-profits.

This did not sit well with Congress. Three House committees called in Mayorkas for a well-deserved drubbing. Things got off to a hot start at Wednesday’s hearing of the House Homeland Security Committee, where Rep. Clay Higgins pressed Mayorkas about his failure to stem the tide of illegal immigration.

When Mayorkas demurred, Higgins cut to the chase saying, “Step away from your talking points, and speak to the American people, and own this thing. We’re losing our country down there and need you to resign. Save the country the pain of your impeachment.”

Mayorkas hit headwinds again Thursday at the House Judiciary Committee, the committee that plays the lead role in impeachment hearings. Rep. Jim Jordan charged that the border crisis was no accident—an argument that would play heavily in an effort to impeach Mayorkas, should conservatives take the majority next Congress.

“It’s intentional. It’s intentional. It has to be. The chaos on our southern border is… deliberate; it is on purpose; it is by design,” he said.

Jordan then listed a series of ruinous policy decisions made as soon as the Biden administration took office, including ending almost all deportations, ending “Remain in Mexico,” terminating agreements with Northern Triangle countries and halting construction of border wall. This onslaught of early actions (tracked here), combined with Biden’s rhetoric beginning on the campaign trail, have had their desired effect: encouraging and enabling more illegal border crossings.

Words matter, and when Biden repeatedly promised to extend amnesty, to shut down Immigration and Customs Enforcement, and most famously “immediately surge to the border all those people seeking asylum,” millions of soon-to-be illegal aliens heard him loud and clear.

They know well enough that all it takes is to show up and say the magic words of “asylum” and they will be let in and never removed. Under Biden, the famous Field of Dreams quote has morphed from “if you build it, they will come” to “if you destroy our border security, they will come.”

Implementation of Biden’s open-borders agenda has been the primary responsibility of Mayorkas. With such responsibility comes accountability. And judging by this week’s hearings, and the American public’s complete lack of confidence in this administration’s handling of the border, strict accountability is on the horizon.

Let’s see if Mayorkas stays around much longer to face it.
